Requirement to make
proper provision
Families can sometimes have complex circumstances which may lead to someone creating a Will which leaves nothing or less than what is proper to certain family members. However, the law places an obligation on a Will maker to make proper provision in their Will for certain family members. The test as to what is "proper provision" can be complicated and takes into account many different factors.

If you are a spouse, de facto partner or child of a deceased who has not been given proper provision under a Will, you may be able to seek (additional) provision from an Estate.

At Willerby's, we can advise you as to your rights and if necessary seek proper provision on your behalf.

We also defend claims on behalf of Estates where someone has sought further provision.
